Planet B – General Terms and Conditions of Sale – Version February 2024
1. General
You have found the general terms and conditions of sale of the Planet B group BV (hereinafter "Planet B" or "we").
With these terms, we aim to inform every customer of our services and products in a clear manner regarding the conditions governing the sale.
We are proud to include the following services and products within the Planet B group:

- Bambooze (https://planetb.be/bambooze-straws);
- Klaaar (https://klaaar.care/ );
- Kiko (https://www.kikofood.com/ ).
Planet B is a Private Limited Company, with its registered office at Wachtebekesteenweg 3, 9180 Moerbeke (Waas), Belgium. You can find us in the Belgian Crossroads Bank for Enterprises under company number 0705.889.784.

We attach great importance to a responsible approach to our legal obligations in this regard and will therefore be obliged to regularly update these general terms and conditions of sale to the new developments in this matter. The most current version will always be available on our websites.
2. Definitions
Customer: any person acting for purposes outside his trade, business, craft, or profession, and who purchases or may purchase Products via the Website.
Agreement: the distance agreement concluded between Planet B and the Customer for the purchase of Products via the Website. The Agreement is governed by these general terms and conditions of sale.
Products: all goods offered for purchase on the Website.
Website: the websites of Planet B, as listed above, including the mobile applications.
3. Applicability
These general terms and conditions of sale apply to every offer from Planet B and to every Agreement between Planet B and the Customer.
These general terms and conditions of sale are made available to the Customer (digitally) prior to the conclusion of the Agreement. The general terms and conditions of sale can be saved in PDF format. If this display or storage is not possible, Planet B can, upon request of the Customer, send them free of charge via email.
4. Formation and duration of the agreement
The offer from Planet B with the accompanying prices is a non-binding offer.
An order can be placed by following the steps as indicated on the Website.
The Agreement is concluded once the Customer has accepted the offer and the general terms and conditions of sale.
5. Prices
The prices on the Products are the prices listed on the Website at the time the Customer places an order. These prices include VAT at the applicable rate in the Customer's country of residence and exclude shipping costs.
Additional shipping costs or other administrative fees will be specified per order in the communication with the Customer before the Agreement is confirmed. These costs depend on the country to which the Products must be shipped.
Obvious errors or mistakes in the offer, such as incorrect pricing and/or other obvious inaccuracies, do not bind Planet B and may be corrected by Planet B after the conclusion of the Agreement.
6. Payment
The Customer can pay for their order through various secure methods:
- PayPal;
- Google Pay;
- Credit card (Visa, Mastercard, Maestro, UnionPay);
- Achteraf betalen met Klarna;
- Bankcontact;
- iDeal (Nederland);
The Customer is required to make payment at the time of placing the order. Planet B will only begin processing the order upon receipt of full payment. If payment is not received within 5 days after the order is placed, Planet B reserves the right to cancel the order. In case of a delay in payment, for example, if the Customer's card issuer refuses to authorize the payment, Planet B cannot be held responsible for delays in processing the order and consequently delays in delivery or even non-delivery of the order. Orders without valid payment under the registered cardholder's name will not be accepted or processed.
7. Subscriptions
In addition to standalone orders, Planet B also offers the Customer the option to subscribe, which involves the Customer agreeing to receive periodic (monthly) deliveries.
Products on subscription are shipped on the same day of the month as the day the subscription agreement is concluded. For example, if the subscription agreement is concluded on the 15th day of the month, the Products on subscription will be shipped on the 15th day of each month.
The Customer has the option to modify, pause, or cancel a subscription at any time. Planet B aims to make this as simple as possible for the Customer: such changes can be reported via email to: hello@klaaar.care or through your account on our Website. However, the Customer should note that any such change request must be submitted at least 14 days before the shipping date of the next subscription order.
8. Gift Card
A gift card can be purchased on the Website.
A gift card cannot be refunded or exchanged and is only usable on our Website or in one of our stores.
9. Shipping and Delivery
Planet B commits to delivering the Products as promptly as possible and no later than within a period of 30 days after the complete receipt of payment. If this delivery period cannot be met, the Customer will be notified by email, and Planet B will provide a new reasonable delivery timeframe.
The indicated delivery times are in any case only indicative. The delivery times are counted in working days, from Monday to Friday, excluding Saturdays, Sundays, public holidays, closure due to vacation, and weather delay days.
The Customer will receive a confirmation via email, and once the order is dispatched for delivery, the Customer will also receive a notification.
The order will be delivered to the address provided by the Customer during the purchase process.
Planet B reserves the right to make partial deliveries of the ordered Products, for example, if part of the order is delayed or unavailable. In the event of partial delivery, Planet B will notify the Customer by email.
The delivery and transportation of the Products are organized by the service providers and carriers that Planet B relies on. By using the option to ship Products, the Customer acknowledges having read and accepted the general terms and conditions of these service providers. In Belgium, Planet B relies on the services of Bpost. In the Netherlands, it relies on the services of PostNL.
The Products are transported at the expense and risk of the Customer. When the value of an order is lower than 25 EUR, Planet B charges a shipping cost of 5.70 EUR. For orders between 25 EUR and 29.99 EUR, Planet B charges a reduced shipping cost of 3.95 EUR. For all orders above 30 EUR, shipping is free. These rates can be unilaterally adjusted by Planet B, based on the actual (transport) costs.
In case of damage or loss of the Products during transport, the Customer should contact the service provider/carrier, which is solely responsible. Planet B cannot be held responsible or liable for actions, statements, or damages of any form or nature caused by external parties (e.g., transport companies).
10. Cancellation of an order prior to delivery
The Customer has the right to cancel the order without giving any reason and without cost before the shipment of the order.
This can be done by sending an email to hello@klaaar.care.
After cancellation of the order, the Customer will receive a confirmation of the cancellation by email, and Planet B will refund the amounts already paid to the credit card, debit card, or bank account used by the Customer for payment.
Once the Products have been dispatched for shipping, the Customer cannot cancel the order anymore. In this case, the Customer can still exercise their right of withdrawal according to the procedure described in Article 11.
11. Right of withdrawal of an order
The Customer has a legal right to withdraw from the Agreement within a period of 14 days, starting from the day following the delivery of the Product.
To exercise the right of withdrawal, the Customer must unequivocally notify this via hello@klaaar.care. No reason for the withdrawal needs to be provided.
Planet B will send the Customer an acknowledgment of receipt of the withdrawal by email.
Planet B has the right to refuse the withdrawal if upon return it is found that the Product shows signs of damage, use, or wear or is no longer provided with its original labels. During the withdrawal period, the Customer must handle (the packaging and) the Products and accessories carefully.
The Customer is responsible for the return shipment of the Product, and the costs of the return shipment are borne by the Customer. The risk and burden of proof associated with the return shipment of the Product are borne by the Customer. The risk and burden of proof for the correct and timely exercise of the right of withdrawal lie with the Customer.
In case of withdrawal:
- Planet B will refund the amounts already paid by the Customer for the Products upon receipt of the Products. Planet B may reduce the refund to account for any depreciation of the Products;
- Planet B will refund the Customer to the credit or debit card or bank account that the Customer used for payment;
- Planet B will have the right to refund the Customer with a gift card if the Customer used a gift card to pay for the Products.
12. Conformity
Planet B guarantees that the Products ordered and delivered by the Customer comply with the Agreement and are suitable for the purpose as described in the information provided by Planet B about the Products. Planet B always describes the Products it sells as fully and accurately as possible. The description is in any case sufficiently detailed to allow the Customer to make a proper assessment. However, Planet B cannot be held liable for any inaccuracies in the shared information, nor assume any responsibility regarding the (technical) information and description of the Products provided by its partners and suppliers.
13. Warranty
Planet B strives to provide the Customer with top-quality products suitable for the purpose as described by Planet B. However, sometimes things may go wrong.
If the Customer identifies a lack of conformity, i.e., when the delivered Product does not correspond to the ordered Product, the Customer must notify Planet B via email at hello@klaaar.care, within a reasonable period after the defect becomes known or could reasonably have been known by the Customer. Along with this notification, the proof of payment and the delivery note or tracking information of the order must also be provided.
The Product can then be returned to Planet B at the expense of the Customer.
After the return of the Product, Planet B will, at the Customer's discretion, either send the Customer a new Product or repair the Product, and Planet B will bear all costs associated with this replacement or repair. The Product can only be replaced and delivered to the extent that it is still in stock. If replacement or repair is not possible or cannot be carried out within a reasonable period, the Customer has the right to terminate the Agreement, and Planet B will refund the price of the order within a reasonable period.

15. Assignment and Subcontracting
Planet B always has the right to assign its rights and obligations under the Agreement or subcontract them to a third party (e.g., for the delivery of the Product).
16. Processing of Personal Data
Planet B uses the Customer's personal data solely in accordance with its Privacy Policy.
17. Liability and Force Majeure
Planet B undertakes to execute the Agreement to the best of its ability (best efforts obligation), but it does not undertake any obligation to achieve a specific result. If Planet B is liable, this liability is in any case limited to the amount paid out by a (professional) liability insurance policy, and in the absence of (full) payment by an insurance company of the amount of damage, the liability is in any case limited to the (part of the) invoice amount to which the liability relates.
Except in cases of fraud or willful misconduct, Planet B is not liable for or obliged to compensate for immaterial, indirect, or consequential damages.
Planet B is not liable for any damage resulting from the Customer's failure to follow product and usage instructions and/or warnings. The Customer also indemnifies Planet B against any claims from third parties for the aforementioned damages.
Planet B's liability for non-compliance with its contractual obligations cannot be invoked in case of force majeure. During the period of force majeure, Planet B's obligations are suspended, and the term for the performance of the obligations will be extended for the duration of the force majeure situation. If the period of suspension lasts longer than 30 days, the Agreement may be terminated in whole or in part, without any obligation to pay damages.
In case of force majeure, Planet B will notify the Customer thereof as soon as possible.
18. Severability
The invalidity or unenforceability of any provision of these general terms and conditions shall nevertheless retain its maximum permitted effect, and this shall not affect the validity or enforceability of the remaining provisions.
19. Entire Agreement
This Agreement constitutes the entire agreement between the parties with respect to its subject matter and supersedes any prior agreement with the same subject matter.
The parties acknowledge that they have entered into this Agreement voluntarily. Each party waives any claim for error regarding the law or the facts, as well as any claim for oversight concerning the existence and/or scope of its rights.
20. Applicable Law
The Agreement between Planet B and the Customer to which these general terms and conditions apply shall be governed exclusively by Belgian law. The Courts of Ghent shall have exclusive jurisdiction.
